Which States Allow Lottery Courier Apps? State-by-State Status (2026)
Quick answer: which states allow lottery courier apps?
There is no single national rule. Whether a lottery courier app may buy Powerball or Mega Millions tickets for you is decided state by state, and the picture changed a lot in 2024 and 2025. According to the Vixio regulatory review of lottery couriers (2025), five states explicitly regulate or permit couriers (New York, New Jersey, Arkansas, Colorado and Oregon), seven states prohibit them or have acted against them (California, Florida, Indiana, Mississippi, Texas, Virginia and Wisconsin), the question is open in three (Arizona, New Hampshire, South Carolina), and most remaining states have no express rule either way.
Rules keep moving, so treat the table below as a starting point and confirm with your state lottery before you sign up with any service. Last checked: 1 November 2026.
State-by-state status of lottery couriers
| State | Status | What changed |
|---|---|---|
| New York | Regulated | Courier services are covered by the NY Gaming Commission rules (9 NYCRR Part 5014) and need a licence; New York has one of the two most detailed frameworks. |
| New Jersey | Regulated | Couriers must register with the state; rules cover responsible gaming, geolocation, independent testing and advertising. |
| Arkansas | Permitted | Couriers operate within the general lottery retailer regulations. |
| Colorado | Permitted | Couriers operate within the general lottery retailer regulations. |
| Oregon | Regulated | The Oregon State Lottery Commission approved a courier framework in October 2025; it took effect on 1 January 2026. |
| Texas | Banned | The Texas Lottery Commission voted to ban couriers on 29 April 2025, and Senate Bill 3070, signed on 20 June 2025, made operating a courier service a Class A misdemeanor. |
| California | Prohibited | In June 2024 the California Lottery declared online lottery services illegal in the state; retailers who sell to couriers risk losing their contract. |
| Indiana | Prohibited | House Bill 1053 (signed 1 May 2025) bars couriers unless a statute expressly authorizes them. |
| Virginia, Wisconsin | Prohibited by statute | Both states ban ticket courier services outright. |
| Mississippi | Not authorized | A February 2024 attorney general opinion found no authorization for couriers. |
| Florida | Enforcement action | In December 2024 the Florida Lottery acted against an unauthorized courier; there is no courier licence. |
| Arizona, New Hampshire, South Carolina | Unresolved | Rules or opinions are pending; check the state lottery for the current position. |
| Other states | No express rule | Couriers may operate without a dedicated framework, and the state lottery can change its position at any time. |

What a lottery courier actually does
A courier is a company that buys official paper tickets from a licensed retailer on your behalf and shows you a scan of the ticket before the draw. That is different from lottery betting sites, which take bets on the result without buying a ticket. With a courier you own a real ticket; with a betting site you hold a bet whose payout depends on that company.
Couriers usually charge a service fee on top of the $2 Powerball or $5 Mega Millions ticket price. Fees, payout rules and how large prizes are handed over differ between services, so read the terms before depositing money.
Federal law in short
Two federal statutes matter. The Wire Act (18 U.S.C. § 1084) was limited to sports betting by the First Circuit in New Hampshire Lottery Commission v. Rosen (2021). Separately, 18 U.S.C. § 1301 makes it a crime to carry lottery tickets across state lines, which is why courier apps check your location and only sell tickets from the state you are in. Federal law does not make couriers legal in a given state; the state decides.
How prizes and taxes work with a courier
- Small prizes: most couriers credit small wins to your account. Check the threshold and any withdrawal fees in the terms.
- Large prizes: prizes above the state claim limit are claimed from the state lottery, normally with the original paper ticket. US lotteries withhold 24% federal tax on prizes over $5,000, and the top federal rate at filing is 37%. State tax ranges from 0% (for example Florida or Texas) to 10.9% in New York State, plus 3.876% New York City tax for city residents.

Checklist before you use a courier
- Check your state lottery’s website for its position on couriers.
- Confirm the service shows a scan of a real ticket before the draw.
- Read the fees, the prize-claim process and the withdrawal rules.
- Use the responsible-play limits the service offers, and play only with money you can afford to lose.

Which states allow lottery courier apps?
New York, New Jersey, Arkansas, Colorado and Oregon explicitly regulate or permit couriers. Texas, California, Indiana, Virginia and Wisconsin prohibit them, Mississippi has found no authorization and Florida has taken enforcement action. Arizona, New Hampshire and South Carolina are unresolved, and most other states have no express rule. Always confirm with your state lottery.
Are lottery couriers legal in Texas?
No. The Texas Lottery Commission banned couriers in April 2025, and Senate Bill 3070, signed in June 2025, made operating a courier service a criminal offense.
Are courier apps legal under federal law?
Federal law does not authorize or ban couriers as such. Since the 2021 First Circuit ruling the Wire Act applies only to sports betting, and couriers must keep tickets inside the state of purchase under 18 U.S.C. § 1301. Legality depends on state law.
How are courier prizes taxed?
Exactly like prizes on tickets bought in a shop: 24% federal withholding above $5,000, up to the 37% top federal rate at filing, plus state tax where it applies.
